INSAFE Product Guarantee & Warranty

1. INSAFE® Tactile Paving Pty Ltd Guarantees and Warrants its Products that manufactured from the said materials for use of normal pedestrian foot traffic in the schedule appearing below:

   1. Drill & Drive® Tactile Paving Studs (Polymer and Glass Reinforced nylon) – 5 years

   2. Drill & Drive® Tactile Paving Studs (Alloy with expandable shaft) – 5 years

   3. INSAFE 316 Stainless Steel Tactile Paving Studs – 10 years

   4. INSAFE 316 Stainless Steel Tactile Paving Studs with 3M Safety-walk® inserts – Not guaranteed by INSAFE Tactile Paving Pty Ltd (3M Safety-walk® is subject to the terms & conditions of 3M®)

2. INSAFE® Tactile Paving Pty Ltd Guarantees and Warrants to the purchaser that the Product:

   1. Is free from all defects.

   2. Is manufactured from the finest grade of new materials & recycled materials or as disclosed.

   3. Is designed, manufactured and tested to comply with the Australian and New Zealand Standards of1428.4 (1992) & (2002) and the requirements of The Building Code of Australia Section D Clause 3.8. These Test and Reports are available on request from INSAFE® Tactile Paving Pty Ltd

   4. Is a Product, which has been subject to intensive testing by an independent Australian testing authority, and as such is certified to be compliant to a level of the prescribed standards for this Product. View the compliance links page for more information.

   5. Is manufactured and designed in such a manner to ensure that the Product is fit for the purpose of its purchase and so that it does not breach or void any benefit or warranty available under Australian and New Zealand Statute Common Law or otherwise.

3. This Guarantee and warranty is subject to:

   1. The Product being installed on an appropriate and stable substrate/surface.

   2. The Product being installed and used for the purpose for which it is designed.

   3. The Product, after application, being maintained in accordance with Tactile Paving Care Instructions.

   4. The laws of Australia and New Zealand.

4. This Guarantee and Warranty will not apply:

   1. To the Application of the Product. Any Application Guarantee or Warranty, either written or verbal, made by INSAFE® Tactile Paving Pty Ltd, one of its Distributors, Agents or Resellers, is done so at the sole discretion and sole responsibility of the Company, Contractor or Individual that applied the Product.

   2. To the use of the product outside Australia and New Zealand.

   3. If the Product is applied for anything other than Pedestrian use.

   4. If the Product is not safely stored in a dry environment prior to use.

   5. If the Product being subject to intentional misuse or unauthorized reapplication or reinstallation or act of God.

   6. If the Product is not maintained with reasonable care and diligence to Australian and New Zealand standards as they apply from time to time.

   7. If the Product is not maintained to the instructions set out in the Tactile Paving Care Instructions.

   8. If the product is subject to abnormal conditions of ware and tear to. I.e., not pedestrian foot traffic.
